TERMS OF SERVICE — DCmove

1. PARTIES AND SUBJECT MATTER
These Terms of Service (the "Terms") govern the contractual relationship between:
Dervet s.r.l. (Via Trescore 32/a, 26020 Palazzo Pignano CR, VAT IT01433620190 — "the Provider")
and
the User (individual or legal entity registering on the platform)
in relation to the use of the DCmove platform (mobile app, cloud backend be.dcmove.cloud).
2. DESCRIPTION OF THE SERVICE
DCmove is an IoT platform enabling registered users to:
- Register, configure and remotely control Dervet devices
- Monitor operational status, diagnostics and device logs
- Manage technical parameters, configuration presets and customisations
- Perform firmware updates remotely (OTA) or via Bluetooth (BLE OTA)
- Submit technical support requests with diagnostic attachments
The Service is intended for industry professionals (installers, maintenance technicians, OEM manufacturers) and end users owning Dervet devices.
3. ACCESS REQUIREMENTS
To use the Service, the User must:
a) Be an adult individual (at least 18 years old) or a legally constituted legal entity; b) Have a compatible smartphone (Android 8.0+ or iOS 14+); c) Complete registration providing truthful, accurate and up-to-date data; d) Accept these Terms and the Privacy Policy before completing registration.
4. REGISTRATION AND ACCOUNT MANAGEMENT
4.1 Account creation
The User is responsible for the accuracy of data provided. Dervet reserves the right to suspend or delete accounts based on false data.
4.2 Access credentials
The User is responsible for keeping credentials confidential. Any suspected unauthorised access must be reported immediately to Dervet.
4.3 User roles
Access to features is modulated based on the assigned role (Administrator, Manufacturer, Installer, User).
4.4 Inactive accounts
Dervet reserves the right to suspend accounts inactive for more than 24 months, subject to e-mail notification.
5. ACCEPTABLE USE
The User agrees to: - Not access other users' devices or data without authorisation - Not reverse-engineer or decompile the software - Not deliberately overload the Service infrastructure - Not upload unlawful content or content that infringes third-party rights - Not use the Service for purposes other than managing legitimately purchased Dervet devices
6. SERVICE AVAILABILITY
Dervet endeavours to provide reasonable continuity of service, but offers no SLA guarantees for non-commercial plans. Interruptions for maintenance or force majeure may occur.
Dervet reserves the right to modify or discontinue the Service with 30 days' notice, except in cases of technical or security emergencies.
7. INTELLECTUAL PROPERTY
All rights to the software, trademarks and know-how of DCmove are the exclusive property of Dervet. User-provided data (device names, presets, images) remains the property of the User.
8. USER DATA AND PRIVACY
Processing of personal data is governed by the DCmove Privacy Policy, which forms an integral part of these Terms. All data is stored on infrastructure managed directly by Dervet in Italy.
9. LIABILITY
9.1 Dervet's liability
Dervet is liable for direct damages caused exclusively by the Service's non-performance, up to the amount paid by the User in the last 12 months. Dervet is not liable for indirect damages or data loss.
9.2 User's liability
The User is responsible for: - Correct use of remote commands (opening/closing industrial doors may pose personal safety risks) - Correct configuration of technical parameters - Safekeeping of access credentials - Compliance with applicable local regulations
9.3 Disclaimer
Dervet is not liable for personal injury or property damage resulting from improper use of remote control commands. The User must ensure the operating area is clear before issuing any command.
10. CHANGES TO THE TERMS
Dervet reserves the right to update these Terms with at least 15 days' notice via e-mail. Continued use of the Service constitutes acceptance of the new Terms.
11. TERMINATION AND ACCOUNT DELETION
The User may request account deletion via the in-app function or by contacting privacy@dervet.com. Upon deletion, personal data is immediately anonymised.
12. GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law. Disputes shall be subject to the exclusive jurisdiction of the courts of Cremona (CR), subject to any mandatory consumer law provisions.
